Terms and Conditions of Membership

1. Terms and Conditions

1.1 These terms and conditions shall govern your membership agreement with the Entrepreneurs’ Forum Limited (“Entrepreneurs’ Forum”). By submitting your application you agree to abide by these terms and conditions, as amended and notified to you from time to time by the Entrepreneurs’ Forum.

1.2 Your membership application is subject to approval by the Entrepreneurs’ Forum (such approval to be given or withheld at the absolute discretion of the Entrepreneurs’ Forum) and payment in cleared funds of all applicable membership fees when due and you will be notified by letter when your application has been accepted.

1.3 Once your application has been accepted, your membership shall (subject always to clause 4 below) continue for so long as the applicable membership fees are paid in full by you in accordance with the following provisions of this clause. At the commencement of your membership and at the expiry of each 12 month period thereafter whilst you remain a member you will be sent a renewal invoice. Your membership shall automatically cease in the event that payment in cleared funds of all applicable membership fees then due as indicated in the applicable renewal invoice is not made by you to the Entrepreneurs’ Forum within the timescales specified in clause 3.3. 
 

2. Services

2.1 Your membership entitles you to attend Entrepreneurs’ Forum events. We may charge for your attendance at an event if, for example, there is external catering provided. We will notify you in advance of any extra cost you will be required to pay if you wish to attend. Should you notify us of your wish to attend a charged event but are subsequently unable to attend the same, you must give us 72 hours notice. Failure to do so will result in you being charged in full for the event. 
 

3. Fees and Payment

3.1 Membership fees are subject to change without notice and are exclusive of VAT which will be added to the fee in question.

3.2 Payment of all fees must be made by cheque, bacs or by direct debit and be made payable to “Entrepreneurs’ Forum”. Payment of all membership fees must be made within 30 days of the date of the applicable payment request. Event fees must be paid prior to the date of the event.

3.3 If you fail to make any payment on the due date then, without prejudice to any other right or remedy available to the Entrepreneurs’ Forum, we shall be entitled (unless prohibited by law) to claim interest and/or compensation for reasonable debt recovery costs under the Late Payment of Commercial Debts (Interest) Act 1998 as amended and supplemented by the Late Payment of Commercial Debts Regulations 2002. 
 

4. Cancellation of Membership

4.1 You may cancel your membership by giving us 3 months’ notice in writing. At the end of this 3 month notice period you will be refunded the unexpired portion of your annual membership fee (if paid).

4.2 We may cancel your membership at any time without notice in our absolute discretion. Unless such cancellation is for a reason stated at clause 4.3 below, we will refund the unexpired portion of your annual membership fee (if paid). All unpaid fees shall fall immediately due in the event of termination pursuant to this clause.

4.3 We will not be obliged to refund your membership fee if we cancel your membership where:

(a) You breach your membership agreement;
(b) You are convicted of a criminal offence; or
(c) Your continued membership may, in our sole opinion, affect the reputation of the Entrepreneurs’ Forum or any of its other members. 
 

5. Privacy Policy

5.1 Unless we inform you otherwise, all events we organise will be held under the Chatham House Rule of confidentiality that, at any of our events, participants are free to use the information received, but neither the identity nor the affiliation of the speaker(s), nor that of any other participant, may be published or disclosed.

5.2 We collect information about you when you apply for membership, register for an event, and provide event feedback. Website usage information is collected using on-line application forms and cookies. 

5.3 With your permission we may place your name, photograph, position, company name and company website address on the “Our members” section of the Entrepreneurs’ Forum website. We will also place your name and company on our membership list. These lists may be viewed by members and non-members of the Entrepreneurs’ Forum. New member names and company names are published on our social media channels and magazines which are available to members and non-members of the Entrepreneurs’ Forum. 

5.4 We would like to send you information about events and services of ours and other members of the Entrepreneurs’ Forum in our group which may be of interest to you. If you have consented to receive marketing, you may opt out at a later date. You have a right at any time to stop us from contacting you for marketing purposes or giving your information to other members of the Entrepreneurs’ Forum. If you no longer wish to be contacted for marketing purposes, please contact info@entrepreneursforum.net 

5.5 You have the right to request a copy of the information that we hold about you. If you would like a copy of some or all of your personal information, please email or write to us at the following address: Baltimore House, Baltic Business Centre, Gateshead, NE8 3DF. We may make a small charge for this service. We want to make sure that your personal information is accurate and up to date. You may ask us to correct or remove information you think is inaccurate. 

5.6 We agree not to forward, submit or publicise any other details, or any information we receive from you, to other members or to third parties without your consent. Please refer to our Privacy Policy on our website for further information. 
 

6. Liability

6.1 Except as set out in clause 6.2, the Entrepreneurs’ Forum will be under no liability to you whatsoever whether in contract, tort, (including negligence), breach of statutory duty, restitution or otherwise for any damage or direct, indirect or consequential loss (all three of which latter terms include, without limitation, pure economic loss, loss of profits, loss of business, lost savings, depletion of goodwill and like loss) howsoever caused arising out of or in connection with your membership of the Entrepreneurs’ Forum or attendance at any of our events.

6.2 These terms and conditions do not exclude our liability (if any) to you for personal injury or death resulting from the Entrepreneurs’ Forum’s negligence, for fraud, or for any matter which it would be illegal for the Entrepreneurs’ Forum to exclude or to attempt to exclude its liability. 
 

7. Severability

7.1 If any clause or part of these terms and conditions is found by any court, tribunal or administrative body of competent jurisdiction to be wholly or partly illegal, invalid or unenforceable in any respect this will not affect any other provision of these terms and conditions which will remain in full force and effect. 
 

8. Governing Law

8.1 The membership agreement will be governed by the law of England and Wales and the courts of England and Wales have exclusive jurisdiction to settle any disputes which may arise out of or in connection with the membership agreement.
